Welcome to madeforfydeos.com (“Website”), the official online store for hardware made for the FydeOS ecosystem. The Website is operated by Fyde Innovations LTD, a company registered in England and Wales under company number 12273803, with its registered office at 124 City Road, London, EC1V 2NX, United Kingdom (“we,” “us,” “our”). By accessing or using this Website, or by purchasing Products from it, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully, in particular the clauses on third-party software and services, disclaimers, limitation of liability, and governing law. If you do not agree to these Terms, please refrain from using the Website.

These Terms govern your use of the Website and your purchase of physical goods. The FydeOS operating system software that ships preinstalled on our devices is licensed, not sold, and its use is governed separately by the FydeOS Terms of Service published at fydeos.io/terms (see Section 7 below).

1. Definitions

  • “We,” “Us,” “Our” — refers to Fyde Innovations LTD, the operator of madeforfydeos.com and the maker of FydeOS.
  • “You,” “Your” — refers to any person accessing or using this Website.
  • “Products” — refers to physical goods offered for sale on this Website, such as the Fydetab Duo, the XpressReal T3, and related accessories.
  • “FydeOS” — refers to the FydeOS operating system software developed by Fyde Innovations, including any release preinstalled on a Product and any updates to it.

2. Eligibility

By using this Website, you represent that you are at least 18 years old or have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. If you are under 18, you should use this Website, and any Product and FydeOS, under the supervision and guidance of a parent or legal guardian.

3. Use of the Website

You agree to use the Website for lawful purposes only. You may not:

  • Engage in fraudulent activity.
  • Disrupt or interfere with the Website’s functionality, or transmit excessive data that could lead to a denial of service.
  • Attempt to gain unauthorised access to our systems, or interfere with the data exchanged between the Website and our servers.
  • Use the Website to distribute harmful or illegal materials, harassing messages, or spam.
  • Alter or remove any copyright, trademark, or other intellectual property notices appearing on the Website.

4. Orders and Payments

  • Order acceptance — all orders are subject to acceptance by Fyde Innovations LTD. We reserve the right to cancel orders at our discretion.
  • Pricing — all prices are shown in GBP (pounds sterling). UK prices are shown exclusive of VAT; VAT at 20% is added at checkout for delivery addresses in the United Kingdom. International customers also pay in GBP; any currency conversion is handled by your card issuer. Shipping is calculated and charged at checkout based on your delivery address (see Section 5).
  • Payments — payments are processed by Shopify Payments and, where offered, PayPal. We do not store or process your payment details. You agree to the applicable provider’s terms when completing your payment. We cannot be held responsible for risks inherent in third-party payment tools, such as fraudulent use of your card or account by others.
  • Pre-orders and backorders — some Products may be offered for pre-order or backorder; the estimated dispatch window is shown on the product page, and our Refund Policy explains your cancellation rights before dispatch.
  • Order updates — after completing an order, you can sign in with your email address (no password required) to track order updates.

5. Shipping and Delivery

We ship products to the address provided during checkout. Shipping is calculated and charged at checkout based on your delivery address. For most destinations we ship Delivered Duty Paid (DDP) by door-to-door express courier (such as DHL, UPS, or EMS), with customs clearance included. Orders are dispatched from our factory and warehouse in China; the actual courier may vary depending on your location. Indicative delivery times are up to 2 weeks for US orders, up to 3 weeks for EU orders, and up to 4 weeks for the rest of the world. Once your order is dispatched, you will receive a tracking number to monitor your shipment. Ensure all shipping details are accurate, as we are not responsible for delivery issues due to incorrect information. Delivery timelines are estimates and may vary based on your location. Risk of loss passes to you upon confirmed delivery of the Products (as evidenced by the carrier’s proof of delivery); loss or damage occurring in transit remains our responsibility.

6. Returns, Refunds, and Warranty

Our return and refund terms, including the one-year limited hardware warranty for eligible Products, are set out in our Refund Policy. By placing an order, you agree to its terms. Nothing in these Terms or in the Refund Policy limits or affects the statutory rights you have as a consumer under applicable law.

7. FydeOS Software Licence

Our devices ship with FydeOS preinstalled. When you purchase a Product, you buy the hardware; the FydeOS software on it is licensed to you, not sold, under the FydeOS Terms of Service at fydeos.io/terms. In summary, and without limiting that agreement:

  • Licence scope — the FydeOS release preinstalled on your Product is licensed on a non-exclusive, non-transferable basis for your personal, non-commercial use. Commercial or organisational deployment requires the FydeOS Enterprise Solution, available separately.
  • Updates — FydeOS may automatically detect and install updates unless you disable this. We may update FydeOS or change or limit some of its functions over time, and older versions may no longer be available after new releases.
  • Hackability — our devices are designed to be hackable. You are encouraged to explore and modify them at the software and firmware levels, and doing so does not void the hardware warranty (see our Refund Policy for what is and is not covered). Replacing or modifying the operating system is at your own risk: we cannot guarantee the functionality, safety, or compatibility of third-party operating systems or software on our hardware, and we do not provide support for them.
  • No software refunds — removing or replacing FydeOS on a Product does not entitle you to any refund, and software (including software packaged with or installed on a hardware product) is not returnable separately from the hardware.

8. Accounts

  • Store account — account sign-in on this Website is optional and passwordless: access is granted via one-time codes sent to your email address. You are responsible for maintaining the security of your email account and for all activities conducted through your customer account. We reserve the right to suspend or terminate accounts for violation of these Terms.
  • FydeOS account — a FydeOS account (used for FydeOS features such as the FydeOS Store, FydeOS Community, and FydeOS AI) is separate from your store account and is governed by the FydeOS Terms of Service. You are responsible for safeguarding your FydeOS account credentials; if you discover unauthorised use of your account, notify us promptly so we can suspend the related services.

9. Third-Party Software, Services, and Links

  • FydeOS and our Products can incorporate or run third-party software, technology, and services (such as third-party app stores, applications, plugins, and third-party AI models). These are provided by third parties and are not under our direct control. We do not endorse them and assume no responsibility for their safety, accuracy, stability, or compatibility with future FydeOS versions. Before installing third-party software, you should independently assess the associated risks and review the third party’s terms and privacy statement.
  • When you use a third-party application or service, you enter into an agreement with that third party. Disputes arising from third-party software or services should be resolved with the relevant provider directly; we do not provide customer support for third-party software.
  • The Website may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of these websites. Accessing third-party websites is at your own risk.

10. Data Responsibility and Backups

You are responsible for the security and backup of data stored on your devices. We cannot retrieve data lost through hardware failure, software modification, repair, or user action, and we are not liable for any such data loss. Please back up your personal data regularly, and before sending a device to us for warranty service or return.

11. Feedback and Contributions

We welcome suggestions, bug reports, and other feedback about our Products, FydeOS, and this Website (“contributions”). Unless explicitly agreed otherwise, you grant us an irrevocable, perpetual, non-exclusive, worldwide, royalty-free licence to use and incorporate your contributions in developing, demonstrating, licensing, distributing, and selling our products and services. Please ensure your contributions do not contain your own or any third party’s confidential or copyright-protected information.

12. Intellectual Property

All content on this Website, including text, images, logos, and design, and all rights in FydeOS, the FydeOS name and logo, and related materials, are owned by or licensed to Fyde Innovations LTD and are protected by the laws of the United Kingdom and corresponding international treaties. You may not reproduce, distribute, or create derivative works of any content without our express written permission.

13. Disclaimer of Warranties

This Website and its content are provided “as is” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, reliability, or completeness of the content on the Website, or that the Website will be uninterrupted or error-free. FydeOS software is provided under, and subject to the disclaimers in, the FydeOS Terms of Service. This section does not limit the hardware warranty set out in our Refund Policy, and nothing in these Terms affects your statutory rights as a consumer in relation to goods you purchase from us.

14. Limitation of Liability

To the maximum extent permitted by law, Fyde Innovations LTD is not liable for any indirect, incidental, special, or consequential damages arising from your use of this Website, FydeOS, or the Products sold on this Website, including loss of business profits, business interruption, or loss of data. We are not responsible for interruption or failure caused by force majeure events that cannot be foreseen, avoided, or overcome, including natural disasters, acts of war, riots, strikes, legislative or policy changes, government actions, or failures of telecommunications networks.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. In jurisdictions where limitations of liability are not allowed, our liability is limited to the fullest extent permitted by law. Nothing in these Terms affects your statutory rights as a consumer.

15. Privacy

How we collect and use your personal data when you browse and buy on this Website is described in our Privacy Policy. Data collected by FydeOS itself when you use the operating system is described in the FydeOS Privacy Statement at fydeos.io/privacy.

16. Jurisdiction and Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, save that if you are a consumer resident elsewhere, you may benefit from any mandatory provisions of, and the jurisdiction of the courts of, the country in which you reside. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

We reserve the right to update or modify these Terms at any time. The “Effective Date” at the top of this page reflects the most recent update. Your continued use of the Website signifies acceptance of any changes; if you do not accept the modified Terms, you should stop using the Website.
